Registration Requirements and Terms and Conditions

FICA DOCUMENTS

Everyone bidding on an auction needs to be compliant in terms of The Financial Intelligence Centre Act (FICA)

ALL DOCUMENTS NEED TO BE PROVIDED PRIOR TO EITHER A LIVE OR ONLINE AUCTION

ONLY ORIGINAL DOCUMENTS OR A CERTIFIED COPY OF THE ORIGINAL WILL BE ACCEPTED

Depending on what capacity you are acting in, the FICA documentation required to vary:

Green barcoded ID/Smart Card ID and Drivers licence or (Passport and Traffic Register licence if you are not a SA Citizen).
Proof of residence not older than 3 months (Must be your physical address) e.g: Utility Bill (Water & Lights) not older than 3 months. TV/DSTV Licence - not older than 3 months. Telephone account: Landline or cell phone account - not older than 3 months. Clothing accounts will also be accepted. Rental Statements.
Proof of deposit (EFT payments must reflect on the day of the auction).

NB – Must be your physical address. PO Box or Private Bag numbers will not be accepted.

Buyers residing at someone else’s premises may submit an affidavit with an ID copy of the owner of the premises.

CK, CC or PTY Business Registration documents.
Green ID/Smart Card ID and proof of residence for each individual member of the business.
Proxy’s ID/ Smart Card ID, Driver’s licence and proof of address not older than 3 months.
VAT Documents.
Business Register Certificate (BRN Certificate).
Business Letterhead/Affidavit authorising individuals to bid on behalf of the business with details of their names and certified copies of their ID.
Proof of address of the business not older than 3 months.
Proof of registration deposit.
Cipro printout (if provided – not older than 1 year).
Letter from the business accountant/auditor/company secretary/director/authorised person, confirming the names of those holding 25% voting rights at general meetings.
FICA Documents of the entities/individuals above 25%.

Proof of address of the business not older than 3 months.
Owner’s Green ID/Smart Card ID.
Letter on business letterhead confirming the existence of the business as a sole proprietorship.
SARS Letter with Tax Number.

Partnerships agreement.
Partners Green ID/Smart Card ID and proof of residence not older than 3 months.
SARS Letter with Vat Number.
Proof of the business address not older than 3 months.
Business Letterhead/Affidavit authorising a representative to bid on behalf of the business.
Proxy’s ID/ Smart Card ID and Driver’s licence.
Proxy’s proof of residence not older than 3 months.
Business Register Certificate (BRN Certificate).

YOU MAY NOT PARTICIPATE ANY AUCTION WITHOUT PROVIDING THESE DOCUMENTS AT REGISTRATION / PRIOR TO THE ONLINE AUCTION!!!

TERMS AND CONDITIONS

Please note the last day of payment is as per Pro Forma Invoice received
Ensure all documents have been submitted upon collection of the vehicle
The vehicle can only be collected once payment has cleared in Burchmore's bank account and once storage has been settled, should there be any storage charges.
Vehicles are sold as-is with no duty to repair
We do not sell subject to finance
No cancellations are allowed or accepted
Should the client buy more than one vehicle, he has to pay for all the vehicles
The client is responsible for roadworthy, licence and change of ownership of the vehicle
The client has 21 days to register the vehicle in his/her name
BURCHMORE'S will do notification of change of ownership
Please be advised that the description and mileage is purely an indication and should be used as a guide only
You are responsible for validating the correct description & mileage.
Please note that the year of manufacture is unknown.
Due to the nature in which the vehicle was received the Odometer reading cannot be guaranteed.
The retail price is not guaranteed.
The Engine number, Chassis / VIN number and Registration number can be found on the License disc. Where no License disc is available the information can be obtained from the Registration Office.

These Rules of Auction comply with the provisions of Section 45 of the Consumer protection Act, 68 of 2008. Sub sections (1), (2) and (3) of this Section provides as follows:

In this section, "auction" includes a sale in execution of or pursuant to a court order, to the extent that the order contemplates that the sale is to be conducted by an auction.
When goods are put up for sale by auction in lots, each lot is, unless there is evidence to be contrary regarded to be the subject of a separate transaction.
A sale by auction is complete when the auctioneer announces its completion by the fall of the hammer, or in any other customary manner, until that announcement is made, a bid may be retracted.
